  1. It is a type of security for the auto insurance that pays for the insured against any damages resulting in the loss of property, destruction, or the damage of another’s property by the auto accident caused during the term of the ownership, use and, the management of the vehicle.
  2. It is an accident in which a vehicle is stolen and is not recovered within 30 days from when it was reported to the police, resulting in the handling of the auto insurance. (This handling is available only if you subscribe to an auto insurance to cover for your own vehicle’s damage.)
  3. This is an accident in which the amount of the insurance coverage to be paid has not yet been determined because the handling of the accident is not completed after the insurance company has begun the handling of the auto accident.
  4. It is an amount paid by the insurance company with the exclusion of the deductible and the error compensation in the case of an insurance accident occurring in an automotive insurance.
  5. If a vehicle is damaged due to an auto accident, it is the direct cost of repairing the car such as components, labor, and painting, with the exclusion of any indirect damages such as auto transportation cost and rental fee and any error compensation, among others.

Terms and Conditions

Article 1 (Purpose)

The purpose of these Terms and Conditions of Use is to specify the rights, obligations, responsibilities and other necessary matters in connection with CarHistory and the use of all of the service related to CarHistory provided by the Korea Insurance Development Institute (hereinafter, “the Institute”).

Article 2 (Definitions)

The terms used in these Terms and Conditions of Use are as follows.

  1. 1. "Service" means any service related to CarHistory and all of the services related to CarHistory that can be accessed through the CarHistory’s website (www.KoreaVin.com) or the mobile app operated by the Institute in English for the used vehicles for export from Korea.
  2. 2. "User" means a person who accesses the "service" and uses the "service" provided by the “Institute” in accordance with these Terms and Conditions of Use.

Article 3 (Effect and Change of Terms)

  1. ① These Terms and Conditions shall become effective through the notice on the screen or by other means providing the "service."
  2. ② The "Institute" can change these Terms and Conditions, and the modified Terms and Conditions will be separately posted on the "service" screen.

Article 4 (Rules Other Than Terms and Conditions)

  1. ① Any matters that are not stipulated under these Terms and Conditions and their interpretations shall be subject to the relevant regulations or practices.
  2. ② The "Institute" may have separate terms and conditions and policies for each individual services, and if any content conflicts with these terms and conditions, the individual terms and conditions shall prevail.

Article 5 (Execution of the User Contract)

  1. ① The user contract is concluded by the "user" using the "service" provided by the "Institute" in accordance with these Terms and Conditions.
  2. ② The “Institute" shall in principle approve of the use of the "service" at the application of the "user." However, the "Institute" may not approve of or terminate the contract afterwards where applicable under any of the following Subparagraphs.
    1. 1. Where any false information has been provided, or the contents proposed by the "Institute" are not provided.
    2. 2. If the approval is not feasible due to the reason of the user's fault, or the application is made in violation of the other prescribed matters.
  3. ③ The "Institute" may withhold the consent if there is no room for the facilities related to the "service," or if there is a technical or business problem.

Article 6 (Provision of "Services," Etc.)

  1. ① The "Institute" provides the following "services."
    1. 1. The repair cost of the vehicle or the insurance payment amount search service, which was compensated for or compensated by with the domestic auto insurance’s own vehicle damage liability or the third party liability insurance since 1996.
    2. 2. Any other service that is disclosed to the "Institute" or provided to the "user" through partnership agreements with other companies, among others.
  2. ② "Service" is provided 24 hours a day throughout the year.
  3. ③ The "Institute" may temporarily suspend the provision of the "service" if there is a maintenance, replacement or breakdown of the information and communication facilities such as computer. In this event, the "Institute" will notify in advance by using the service provision screen. However, if there is an inextricable circumstance under which the "Institute" can not notify in advance, it can notify afterwards
  4. ④ The "Institute" can carry out periodic inspection if necessary for the provision of service, and the regular inspection time will follow what is provided through the notification on the service provision screen.

Article 7 (Limitation of "Service")

  1. ① The "service" provided by the "Institute" has the following information related limitations.
    1. 1. It is provided based on the domestic auto accident data of the non-life insurance companies since 1996, and it is not provided on the matters whose facts of accidents were not reported to the non-life insurance companies or whose insurance accidents were not handled or processed.
    2. 2. "Service" may be changed or delayed in accordance with the circumstances of the information source institutions providing the service’s basic data to the "Institute,” and any inaccurate data may be provided with due to certain errors in the data processing by the information source institutions.
  2. ② The “service” of the “Institute” should be used under the judgment and responsibility of the user only for the purpose of assisting the quality inspection of the used car.

Article 8 (Obligations of the "Institute")

  1. ① The "Institute" does not engage itself in the acts prohibited under the relevant laws and these Terms and Conditions, and strives to provide the "service" continuously and reliably.
  2. ② The "Institute" shall have a security system to ensure that the "user" can use the "service".

Article 9 (Obligations of the “User”)

  1. ① The "user" should not engage in the following acts.
    1. 1. Utilizing the "service" for any purposes other than its utilization as an auxiliary information for verifying the used car’s quality.
    2. 2. Changes in the information provided by the "Institute."
    3. 3. Posting the information obtained by using the service on the Internet or providing it to any others (except for the purpose of selling the vehicle owned by the “user” him or herself).
    4. 4. Using the information obtained by using the "service" for commercial purposes by copying, transmitting, publishing, redistributing, broadcasting or otherwise without the prior consent of the Institute.
    5. 5. Infringing upon the intellectual property rights such as the copyrights of the "Institute" and other third parties.
    6. 6. Degrading the reputation of the "Institute" and other third parties or disrupting their business.
    7. 7. Other illegal or unreasonable acts.
  2. ② The "user" shall comply with the related laws, the provisions of these Terms and Conditions, the user guidelines, and the notices made in relation to the "service" and the matters notified by the "Institute," shall not act to interfere with the business of the “Institute.”
  3. ③ The "user" must comply with the provisions of these Terms and Conditions and the relevant laws and regulations.

Article 10 (Disclaimer)

  1. ① The "Institute" shall not be responsible for the disruption of the use or the suspended provision of the “service” due to natural disasters, power failure, explosion of the usage volume, or other force majeure, and causes imputable to the “user.”
  2. ② The "Institute" shall not be responsible for the results to the "user" caused by any reasons other than any cause imputable to the "Institute" in the use of the "service."

Article 11 (User Fee)

  1. ① In order to use the fee based service provided by the "Institute," the user must pay the fee for the use as specified by the "Institute."
  2. ② The user fee is the same as in the [Attached Table], and in the event of any change, the “Institute” will inform the users by applying the method provided under Article 3 Paragraph (1) mutatis mutandis.

Article 12 (Dispute Arbitration and Competent Court of Jurisdiction)

  1. ① The laws of the Republic of Korea shall apply to any lawsuits filed between the "user" and the "Institute" in connection with the use of the "service."
  2. ② The lawsuits concerning the disputes between the "Institute" and the "user" shall be subject to the jurisdiction of the district court having jurisdiction over the headquarters of the "Institute."

Supplementary Provisions

Article 1 (Date of Enforcement) These Terms and Conditions of Use shall enter into force and be effective from October 1, 2017.
